October 26th Meeting

The Council Meeting of October 26, 2015 begins at 7pm.

  • Council will receive a delegation from Ms. Karin Falconer, who is requesting completion of the south Riverside Drive sidewalk east from its terminus near Pinewood to Lacasse Boulevard, in order for residents to more easily access their new community mailbox location.  
  • Council will also be recognizing the Town of Tecumseh's Director of Staff Services and Clerk, Laura Moy, with 20 Years of Membership Service from the Association of Municipal Clerks and Treasurers of Ontario.  
  • The Director of Information Systems will also provide Council with a presentation regarding the Town's Geographic Information Systems.

Communications include:

  1. County of Essex, September 30, 2015 Re: Notice of Public Meeting & Complete Application, Official Plan Amendment (OPA-1-2015, Town of Kingsville).  The public is invited to comment on the re-designation of agricultural land adjacent to the Kingsville Golf and Country Club to a Settlement Area in the County Official Plan.  The meeting will be held on Wednesday, November 4th at 6:45pm in the Council Chambers at the Essex County Civic Centre.
  2. Town of Lakeshore, Notice of Public Meeting Re: 5 Year Official Plan Review.  The Town of Lakeshore is hosting a statutory public meeting to introduce its Official Plan Review on Tuesday November 10th at 6pm.
  3. Ontario Good Roads Association, October 13, 2015 Re: Call for Nominations.  The Ontario Good Roads Association is seeking nominations for its Board of Directors.  One vacancy exists in our area (the Southwest Zone)
  4. Glen Murray, Minister, October 16, 2015 Re: Great Lakes Protection Act.  The Minister of the Environment and Climate Change announced that the Great Lakes Protection Act has now passed the Ontario Legislature.
  5. Tecumseh Area Historical Society Re: 5th Annual Fundraiser.  The Tecumseh Area Historical Society announces that their annual fundraiser will take place on Saturday November 14th beginning at 4:30pm at the Royal Canadian Legion, Branch 261.

Reports include:
A. Deputy Clerk, September 23, 2015, Report No. 36/15 Re: Renewal of Cat Intake Agreement with the Windsor Essex County Humane Society for 2016.  Council is being requested to approve a Cat Intake Agreement with the Windsor/Essex County Humane Society (WECHS) for 2016 to permit stray cats to be dropped off at a cost of $10 to the resident and $20 to the Town for each cat.  Funding for the Cat Intake Program would be reduced from $3,500 to $2,500 in the 2016 Budget and that funding for the Cat Spay and Neuter Voucher Program be increased from $3,750 to $4,750 in the 2016 Budget.

B. Deputy Clerk, October 5, 2015, Report No. 38/15 Re: Cat Spay and Neuter Voucher Program 2016.  Administration is recommending that the Town continue the Cat Spay and Neuter Voucher Program (Program) in 2016 wherein the total number of vouchers would be increased from 75 to 95 vouchers in 2016, with a value of $50 each.  Vouchers would be distributed for the spay or neuter of Feral Cats, to a maximum of five (5) vouchers per caregiver of feral cats.  Vouchers would also be allocated for the spay or neuter of Owned Cats, to a maximum of three (3) vouchers per household for low income families.  Vouchers would be available early April 2016 and issued on a first come, first serve basis with a 120-day expiry period.

C. Director Staff Services/Clerk, September 14, 2015, Report No. 39/15 Re: Closed Meeting Investigator Appointment.  Administration is recommending not renewing the appointment of John Maddox as Closed Meeting Invesigator and is recommending that this service be contracted to Local Authority Services, which is operated through the Association of Municipalities of Ontario, at a cost of $330 and an hourly investigation rate of $225 for a two year term commencing January 1, 2016.  Administration is recommending against the use of the Ontario Ombudsman to provide this service free of charge.

D. Director Financial Services/Treasurer, October 16, 2015, Report No. 15/15 Re: Budget Variance Report - August 31, 2015.  Council is apprised of the status of surpluses and deficits in various accounts and projects.  Administration is requesting that Council approve: a) Establishment of a Community Improvement Program Reserve (CIPR) for the purpose of managing CIP funding, b) Transferring the 2015 unexpended allocation of $40,000 to the CIPR, and c) Rescind the original reserve funding, $8,600 from each of Roads Lifecycle and Water and Sanitary Sewer Reserve Funds, for the partial funding of the Drainage Department.

E. Director Fire Services/Fire Chief, October 19, 2015, Report No. 05/15.  Re: Fire Chief's Q3 of 2015 Fire Rescue Services Update
05-15.  The Fire Chief provides his quarterly update with respect to inspections and public education.

F. Manager Planning Services/Senior Planner, October 19, 2015, Report No. 32/15 Re: Zoning Bylaw Amendment, 1277165 Ontario Ltd. c/o Laura and Mark Williams, 13072 County Road 34.  Council is being asked to schedule a public meeting, to be held on Tuesday, November 24, 2015 at 5:30 p.m., in accordance with The Planning Act for a Zoning By-law Amendment application seeking to amend the Sandwich South Zoning By-law 85-18 by rezoning a 0.38 hectare (0.95 acre) property situated on the north-west corner of the County Road 34/County Road 19 intersection (13072 County Road 34), from “Rural Commercial Zone (CR-10)” to an appropriate site specific commercial zone to permit the proposed conversion of the former funeral home establishment to an art gallery/studio and retail hobby shop, legally recognize the existing single-unit residential dwelling that is also located on the subject property, and permit a broader range of commercial uses that are contemplated by the Neighbourhood Commercial designation in the Official Plan.

G. Development Coordinator, October 21, 2015, Report No. 34/15 Re: 2015 Provincial Review of the Municipal Act, Formal Request for Amendment to Municipal Act, Registration of Municipal Work Orders and Zoning Orders on Title.  Administration is recommending that Council pass a resolution petitioning for changes the Municipal Act which would provide for the registration of Orders issued pursuant to paragraphs 444 and 445 of the Municipal Act on the title of the property that is the subject of the Order, and ii) amend sentence 444. (1) by inserting the words “or any other ” between the words “this” and “Act,”.  This is felt to be necessary as the use of title insurance for real estate transactions has resulted in a loss of the effectiveness of municipal orders as their existence is no longer a subject of most real estate transactions.  Administration wishes to maintain a system whereby the existence of outstanding municipal orders are identified and resolved as part of a real estate transaction by keeping registration of municipal orders on title.

H. Drainage Superintendent, September 17, 2015, Report No. 53/15  Re: Request for Approval by Resolution for Drainage Apportionment Agreement.  The Drainage Superintendent has reached agreements regarding costs with all benefiting property owners for general cleaning of the Ninth Line Drain, South Talbot O’Connell Drain, and Wolfe Drain, and is seeking Council's approval of said agreements.  

I. Manager Roads and Fleet, September 17, 2015, Report No. 55/15  Re: Clearing and Enforcement of Snow Removal from Sidewalks, Review of Options.  Administration has provided some options for Council to consider with respect to improved snow clearing and enforcing of snow removal from sidewalks within the Municipality.  These options include Status Quo, increased By-law Enforcement for non-compliance ($18,000 annual salary plus $18,000 vehicle purchase), absorbing the responsibility for clearing all sidewalks by hiring more Town Staff ($114,000 annually over 10 years), or hiring of a contractor to clear all sidewalks ($70-150,000).  The fine for non-compliance is $55.00.

J. Drainage Superintendent, October 27, 2015, Report No. 58/15 Re: Branch of the South Talbot & Holden Outlet Drain - Tender Award.  Administration recommends that the tender for the Branch of the South Talbot & Holden Outlet Drain in the amount of $57,506 excluding HST, be awarded to Murray Mills Excavating & Trucking (Sarnia) Ltd. and that the Town’s portion of the assessed costs estimated at $23,020 for Benefit and Outlet Liability be funded from the Municipal Drain Lifecycle Reserve.

K. Manager Roads and Fleet, October 15, 2015, Report No. 61/15 Re: Proposed Sidewalk Extension on Riverside Drive from East of
Pinewood Crescent to Lacasse Boulevard.  Administration recommends that this and completion of other dead-ended sidewalks be funded as part of 2016 Capital Budget.

L. Manager Recreation Programs/Events, October 13, 2015, Report No. 26/15 Re: Pathway to Potential 2015 Funding Agreement
26-15. Administration is recommending signing an agreement with Pathway to Potential to allow for the release of National Child Benefit funding to the Town of Tecumseh in the amount of $24,000, to support recreational programs.  

M. Manager Parks and Horticulture, October 21, 2015, Report No. 27/15  Re: Tender Award for the Request for Quotations Design and Supply of Playground Equipment.  Council is being asked to approve the following playground replacements:  Crozier Enterprises Ltd ($20,000 plus HST) for Abraham Park, Open Space Solutions Inc. ($18,268.99 plus HST) for Green Acres Park, Open Space Solutions Inc. ($19,068.24 plus HST) and Gerry Lesa Park, and Henderson Recreation Equipment Ltd. ($24,959.95 plus HST) for Cranbrook Park.

Our next meeting of Council will be Saturday, October 31, 2015 at 9:00 am for a Road Tour of Capital Projects.  The next regular meeting date will be Tuesday, November 10, 2015, beginning at 6:30 pm with the Public Council Meeting Re: O`Keefe Drainage Report and 7:00 pm for the Regular Council Meeting
